While the U.S. Senate passed anti-torture legislation, the two Texas Senators, John Cornyn and Ted Cruz, were split on the decision.

The amendment to the National Defense Authorization Act restricted the use of torture by the CIA and counter-terrorist officials to techniques listed in the publicly available Army Field Manual on human intelligence collection.  It passed the U.S. Senate by a 78-21 vote, with Ted Cruz voting in the majority and John Cornyn voting in the minority.  According to Cruz,

Civilized nations do not engage in torture and Congress has rightly acted to make absolutely clear that the United States will not engage in torture.  This amendment puts all of our intelligence, law enforcement, and defense personnel on the same page as they work together to keep America safe and our counter-terrorism abilities strong.

Cornyn reportedly opposed the new amendment as it would limit interrogation tactics to publicly known means, allowing potential enemies to prepare in advance.
